Description of the services and conclusion of the contract 1.1 Wolt offers Users of the platform the possibility to place orders with third-party suppliers. Wolt acts as a broker or reseller for these orders. Third-party suppliers are suppliers who do not have a contractual relationship with Wolt, except for potential purchase contract conditions. 1.2. In deviation from Section III. 1.2. of the User Terms of Service and Purchase, a broker contract or a purchase contract of the goods is concluded between Wolt and the User as soon as the User has placed a binding order for the brokerage of a contract or an order on the platform. Section III. 2. shall apply accordingly regarding the conclusion of the contract and the order. If the User bindingly places the order for the brokerage of a contract, Wolt will forward this order on behalf of the User to the third-party supplier who will sell the offered products as well as, if applicable, delivery services to the User in its own name and for its own account. Wolt does not charge any commission to the User for the brokerage of the contract. If the User places a binding order on the platform, Wolt acts as a reseller and sells the offered products and, if applicable, delivery services to the user via the Wolt Service. 1.3. The third-party suppliers are not in a contractual relationship with Wolt if the User gives Wolt the order to brokerage a contract between him and the third-party supplier. If the User acquires the goods from Wolt as a reseller, there are no deviations from the User Terms of Service and Purchase. 1.4. In the description of the third-party suppliers it is specified in each case who is the seller of the offered products and thus your contractual partner. If a third-party supplier is your contractual partner, additional terms and conditions of purchase of the third party may apply. 2. Terms of payment, prices, refunds If the User places a binding order for the brokerage of a contract and a third-party supplier becomes the contractual partner, the user pays the purchase price, including any agreed delivery and service fees, directly to the third-party supplier in deviation from Section III. 4. of User Terms of Service and Purchase. Payments to the third-party supplier shall be made upon delivery in accordance with the third-party supplier's terms of payment. The use of Wolt Credits is excluded when ordering from third parties. 3. Data Protection Wolt is entitled to transfer all data necessary for the execution of the contract ( Section 6. of the Wolt Privacy Policy Statement https://explore.wolt.com/en/deu/privacy). 4. Miscellaneous In all other respects, the User Terms of Service and Purchase remain unaffected and also apply to third-party suppliers unless otherwise stipulated.
